Niagara River Energy Inc. ("Niagara River Energy," "the Company," "we," "us," or "our") respects your privacy. This Privacy Policy describes how we collect, use, disclose, and protect information when you visit our website at niagarariverenergy.com (the "Site"), use our customer portal at portal.niagarariverenergy.com (the "Portal"), or otherwise do business with us as an energy services company. By using the Site or the Portal, you agree to the practices described in this Privacy Policy.

1. Information We Collect

1.1 Information You Provide to Us

  • Contact information you submit through our Site, such as your name, email address, phone number, and company name, when you reach out through our contact form or by email.
  • Account and enrollment information you provide when you sign up for Niagara River Energy service or log in to the Portal, such as your username, password, billing and service address, and account identifiers.
  • Communications you send us, including correspondence, support requests, and any information you choose to include in them.

1.2 Energy Usage and Utility Account Data

If you authorize it, we receive energy usage data and related utility account information about your electric or gas account (for example, historical and interval usage, rate class, and account identifiers) from your utility or through a Green Button "Connect My Data" authorization, as described in our Scope of Disclosure for Third-Party Access to Energy Usage Data. This data is used only for the purposes you authorize, such as preparing quotes, enrolling and servicing your account, and billing.

1.3 Information Collected Automatically

When you visit the Site or Portal, our web server and hosting infrastructure may automatically log standard technical information, such as your IP address, browser type, device type, pages viewed, and the date and time of your visit. We use this information for security, to maintain and troubleshoot the Site and Portal, and to understand aggregate usage.

1.4 Cookies

The Portal may use cookies or similar technologies that are necessary to keep you signed in and to remember your preferences (such as a "Remember Me" login option). We do not currently use third-party advertising or tracking cookies on the Site.

2. How We Use Your Information

We use the information we collect to:

  • Provide, maintain, and improve the Site and the Portal;
  • Prepare energy supply quotes and proposals;
  • Enroll, bill, and service your energy supply account;
  • Respond to your inquiries and provide customer support;
  • Communicate with you about your account, service, or requests you have made;
  • Comply with our contractual, legal, and regulatory obligations, including obligations to your utility and applicable public utility commissions; and
  • Protect the security and integrity of the Site and Portal.

3. How We Disclose Information

We do not sell your personal information. We may share information:

  • With your utility, to enroll or manage your energy supply account;
  • With service providers who host our Site and Portal, process billing, or otherwise support our operations, under obligations to protect your information and use it only to perform services for us;
  • As required by law, including in response to a valid request from a regulator, public utility commission, or court;
  • In connection with a business transaction, such as a merger, acquisition, or sale of assets, subject to appropriate confidentiality protections; and
  • With your consent, for any other purpose you authorize.

Energy usage data obtained through a Green Button or utility data-sharing authorization is used and disclosed only as described in that authorization and our Scope of Disclosure for Third-Party Access to Energy Usage Data. We do not sell energy usage data, and we do not use it for purposes beyond those you authorize.

4. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect the information we collect from unauthorized access, use, or disclosure. The Portal requires a username and password to access your account information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

5. Data Retention

We retain personal and account information for as long as necessary to provide service to you, comply with our legal and regulatory obligations, resolve disputes, and enforce our agreements.

6. Your Choices and Rights

California residents should also see Section 7, "Your California Privacy Rights (CCPA/CPRA)," which describes specific rights available under California law.

  • You may contact us at any time to ask what information we hold about you, to request a correction, or to request deletion, subject to our legal and contractual obligations.
  • If you authorized third-party access to your energy usage data, you may withdraw or modify that authorization at any time by contacting us or your utility, as described in the Scope of Disclosure document.
  • You may decline to provide certain information, but this may limit our ability to provide a quote or service to you.

7. Your California Privacy Rights (CCPA/CPRA)

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the "CCPA"), gives you certain rights regarding your personal information. This section describes those rights and how to exercise them.

7.1 Categories of Personal Information We Collect and Disclose

We collect data as described in Section 1 above, which fall within the following CCPA categories: identifiers (such as name, email address, phone number, and IP address); account information; commercial information (such as billing and energy usage account details); internet or other electronic network activity information (such as pages viewed and log data); and, where you authorize it, energy usage data that may be considered utility or commercial information. We collect this information directly from you, automatically through your use of the Site and Portal, and from your utility or a Green Button "Connect My Data" authorization. We disclose these categories of information to the categories of third parties described in Section 3 above (your utility, service providers, regulators, and parties involved in a business transaction) for the business purposes described in Section 2.

We do not sell or share personal information (as those terms are defined under the CCPA) and have not done so in the preceding 12 months. We do not use or disclose sensitive personal information for any purpose other than the limited purposes permitted under the CCPA without a right to limit, such as providing the services you request and detecting security incidents.

7.2 Your Rights

Subject to certain exceptions and limitations under the CCPA, California residents have the right to:

  • Right to Know what personal information we have collected, used, disclosed, and (if applicable) sold about you, including the categories of sources, the business or commercial purpose for collecting it, and the categories of third parties with whom we share it;
  • Right to Delete personal information we have collected from you, subject to certain exceptions (for example, information we need to provide service, complete a transaction, or comply with a legal obligation);
  • Right to Correct inaccurate personal information we maintain about you;
  • Right to Opt-Out of Sale or Sharing of your personal information; as noted above, we do not currently sell or share personal information, so no opt-out is required to achieve this;
  • Right to Limit the Use and Disclosure of Sensitive Personal Information to only what is necessary to provide the services you request; and
  • Right to Non-Discrimination for exercising any of your CCPA rights. We will not deny you goods or services, charge you different prices or rates, or provide a different level or quality of goods or services because you exercised a right under the CCPA.

7.3 How to Exercise Your Rights

We may need to verify your identity before processing your request, which may require you to provide additional information. You may also designate an authorized agent to submit a request on your behalf by providing us with written authorization or proof of the agent's authority to act on your behalf; we may still require you to verify your own identity directly with us. If we deny your request, in whole or in part, you may ask us to reconsider that decision by replying to our response with an explanation of why you believe reconsideration is warranted.

8. Children's Privacy

The Site and Portal are intended for business and residential customers of legal contracting age and are not directed to children. We do not knowingly collect personal information from children.

9. Third-Party Links

The Site may contain links to third-party websites. We are not responsible for the privacy practices of those sites, and we encourage you to review their privacy policies.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be posted on this page.
