Scope of Disclosure for Third-Party Access to Energy Usage Data

Purpose

This document outlines the scope, limitations, and intended use of energy usage data disclosed to Niagara River Energy, Inc. ("the Company") by you ("the Customer").

Data Included in Disclosure

The following information is authorized for disclosure:

  • Aggregate energy consumption data (e.g., kWh, therms) by facility or operational unit.
  • Historical usage data, including monthly, quarterly, or annual consumption patterns.
  • Peak demand figures and time-of-use data where available.
  • Energy efficiency performance metrics, if applicable.
  • Carbon emissions calculations directly derived from energy usage.

Data Excluded from Disclosure

The following data will not be disclosed unless expressly authorized in writing:

  • Personally identifiable information (PII) of employees or customers.
  • Financial information unrelated to energy procurement or usage.
  • Proprietary business operations data not directly related to energy usage.
  • Any data protected under confidentiality or data protection agreements.

Permitted Uses

Disclosed data may only be used for the following purposes:

  • Energy efficiency analysis or benchmarking.
  • Sustainability reporting and ESG assessments.
  • Energy procurement and demand response planning.
  • Regulatory or compliance reporting.
  • Development of proposals for energy-saving initiatives or technologies.

Restrictions

Niagara River Energy will not:

  • Share or resell the data to other entities without prior written consent.
  • Use the data for marketing, solicitation, or any non-approved purposes.
  • Alter or misrepresent data for public or commercial use.

Data Security & Confidentiality

Niagara River Energy will implement reasonable safeguards to protect disclosed data from unauthorized access or misuse. All access must comply with relevant data protection laws and contractual confidentiality obligations.

Duration and Revocation

Access to data is granted until revoked. The Customer reserves the right to revoke access at any time for any reason, with or without notice.
